Repealed regulation continues to apply to general power of attorney in particular circumstances
177 Repealed regulation continues to apply to general power of attorney in
particular circumstances
(1) This section applies in relation to a document that is a
general power of attorney if— (a) before the commencement, the document was
signed by a signatory or substitute signatory, and a person witnessed the
document, under the repealed regulation; and
(b) immediately before the
commencement— (i) the person had not confirmed the document as the document
witnessed by the person under the repealed regulation; or
(ii) a special
witness had not signed a certificate for the document in accordance with the
repealed regulation; or
(iii) the person had not complied with another
requirement relating to the document under the repealed regulation.
(2)
Despite the repeal of the repealed regulation, the repealed regulation
continues to apply to the person in relation to the document as if the
amending Act had not been enacted.
