Provision of legal representation
10.7 Provision of legal representation
(1) The commissioner may provide legal representation on behalf of any
officer, staff member or recruit against whom any action, claim or demand or
proceeding in respect of an offence is brought or made otherwise than by or on
behalf of the Crown in any of its capacities on account of any action done or
omission made by the officer, staff member or recruit acting, or purporting to
act, in the execution of duty.
(2) If it is found, or conceded, in relation
to any such action, claim, demand or proceeding that the officer, staff member
or recruit, was not acting in the execution of duty in doing the action or
making the omission on which the action, claim, demand or proceeding is based,
the commissioner may recover from the officer, staff member or recruit the
amount of costs and expenses incurred by the commissioner in providing legal
representation under subsection (1) in any court of competent jurisdiction as
a debt due and payable by the officer, staff member or recruit to the
commissioner and unpaid.
