Providing specimen of breath for alcohol test or random alcohol test
5A.10 Providing specimen of breath for alcohol test or random alcohol test
(1) If a relevant person is required to submit to an alcohol test or a random
alcohol test under this part, an authorised person may require the relevant
person to provide a specimen of breath for the test.
(2) The authorised
person may require the relevant person to provide the specimen to the
authorised person’s satisfaction.
(3) The relevant person must comply with
a requirement under subsection (2) .
(4) The authorised person must perform
the test— (a) using an instrument approved by the commissioner for the
purpose; and
(b) in accordance with the manufacturer’s instructions for use
of the instrument.
