Lessee’s right to independent legal advice
47 Lessee’s right to independent legal advice
(1) A lessee or prospective lessee under a retail shop lease must not be
compelled to use, or pay for (in whole or part), the services of a lawyer
nominated by the lessor.
(2) If a person is compelled to use the services of
a lawyer in contravention of subsection (1) , the lessor is liable to pay to
the person the amount paid by the person for the services.
