STATE DEVELOPMENT AND PUBLIC WORKS ORGANISATION ACT 1971 - SECT 157B
Power to give enforcement notice
(1) This section applies if the Coordinator-General reasonably believes a
person has contravened, or is contravening, an enforceable condition.
(2) The
Coordinator-General may give the person a written notice (an
"enforcement notice" ) requiring the person to— (a) comply with the
condition; or
(b) take stated steps the Coordinator-General considers are
reasonably necessary to ensure compliance with the condition.
(3) Without
limiting subsection (2) (b) , an enforcement notice may— (a) require the
recipient to not start, or stop, a stated activity indefinitely, for a stated
period or until further notice from the Coordinator-General; or
(b) require
the recipient to carry out a stated activity only during stated times or
subject to stated conditions; or
(c) require the recipient to take stated
action within a stated period.
(4) An enforcement notice may also require the
recipient to notify the Coordinator-General when the recipient has complied
with the notice.
(5) To remove any doubt, it is declared that this section
does not— (a) affect a power under another Act to enforce a condition; or
(b) prevent the bringing of a proceeding for an offence against another Act.
Note— See, however, the Acts Interpretation Act 1954 , section 45 (Offence
punishable only once).
