Termination of right of retention
44 Termination of right of retention
(1) The unpaid seller of goods loses the right of retention— (a) when the
unpaid seller delivers the goods to a carrier or other bailee for the purpose
of transmission to the buyer without reserving the right of disposal of the
goods;
(b) when the buyer or the buyer’s agent lawfully obtains possession
of the goods;
(c) by waiver thereof.
(2) The unpaid seller of goods, having
a right of retention thereof, does not lose that right by reason only that the
unpaid seller has obtained judgment for the price of the goods.
