References to amounts otherwise being discharged
149A References to amounts otherwise being discharged
(1) A reference in this Act to a person otherwise discharging an amount, other
than by paying the amount, is a reference to the person satisfying the amount
in full by any 1 or a combination of the following— (a) payment of an
amount;
(b) the payment of instalments under a payment plan;
(c) undertaking
activities under a work and development order.
Example— The $2,000 amount
of a person’s SPER debt is otherwise discharged if the person makes a
payment to SPER of $250, is subject to a work and development order for $750
and enters into a payment plan for the remaining $1,000.
(2) However, the
person ceases to be satisfying the amount if— (a) the person is satisfying
all or part of the amount through the payment of instalments under a payment
plan and the plan is cancelled; or
(b) the person is satisfying all or part
of the amount by undertaking activities under a work and development order and
the order is withdrawn or revoked.
