174A Particular orders made under Industrial Relations Act 2016
(1) Subsection (2) applies if, before the commencement of this section— (a)
a magistrate gave particulars of a relevant order to the court registrar for
the purpose of registering the prescribed particulars, in relation to the
unpaid amount payable under the order, under section 34; or
(b) a court
registrar purported, under section 34, to give to SPER, for registration, the
prescribed particulars in relation to the unpaid amount payable under the
order.
(2) The giving of the particulars by the magistrate and the giving of
the prescribed particulars by the court registrar is, and always has been,
lawful.
(3) Subsection (4) applies if, before the commencement of this
section— (a) the registrar purportedly registered, under section 34,
prescribed particulars in relation to the unpaid amount payable under a
relevant order; or
(b) a person took action purportedly under the Act to
enforce a relevant order.
(4) The registration of the prescribed particulars,
and the action taken, is as valid, and always has been as valid, as if, at the
time the relevant order was made, it was an order to which section 34 applied.
(5) In this section—
"relevant order" means an order mentioned in the Industrial Relations Act 2016
, section 380 (1) or 406 (1) .
