STATE PENALTIES ENFORCEMENT ACT 1999 - SECT 27
When infringement notice offence is to be decided by court
27 When infringement notice offence is to be decided by court
(1) If, within 28 days after the date of an infringement notice, an alleged
offender— (a) elects under section 22 (1) (b) to have the matter of the
offence decided by a Magistrates Court; or
(b) takes no action under
section 22 ;
a proceeding for the offence may be started under the
Justices Act 1886 .
(2) Subsection (1) (b) does not prevent the administering
authority from giving SPER prescribed particulars of the offence for
registration under part 4 .
