Deciding application
31 Deciding application
(1) After considering an application to change a specific condition, the chief
executive may decide to— (a) grant the application; or
(b) refuse to grant
the application.
(2) In granting the application, the chief executive may
amend or remove a specific condition of the licence to the extent it is
necessary to grant the application.
(3) However, a
limited wholesale condition may only be applied to a retail licence if retail
sales are the primary activity of the business to which the licence relates.
(4) The change to a specific condition takes effect on the day stated in the
notice of the decision.
(5) If the decision is to grant the application, the
chief executive must give the applicant a replacement copy of the licence
incorporating the granted changes.
