Additional power to require information or produce document
126M Additional power to require information or produce document
(1) This section applies if an authorised person reasonably believes a person
may be able to give information or produce a document that will help deal with
a dangerous situation.
(2) The authorised person may require the person to
give the information or produce the document.
(3) The person must give the
information or produce the document, unless the person has a reasonable
excuse. Penalty— Maximum penalty— (a) if the contravention results in
the death of, or grievous bodily harm to, a person—270 penalty units; or
(b) otherwise—135 penalty units.
(4) The fact that giving the information
or providing the document might tend to incriminate the person is not a
reasonable excuse for subsection (3) .
(5) However, evidence of, or directly
or indirectly derived from, the information or the production of the document
that might tend to incriminate the person is not admissible in evidence
against the person in a proceeding, other than a proceeding for— (a) an
offence against section 130 or 131 ; or
(b) another offence about the falsity
of the information or document.
