TRANSPORT OPERATIONS (PASSENGER TRANSPORT) ACT 1994 - SECT 129ZN
Hearing of application
129ZN Hearing of application
(1) If a respondent appears before the court that is to hear and decide an
application for a civil banning order, the court may— (a) hear and decide
the application; or
(b) adjourn the application, whether or not it makes an
interim civil banning order; or
(c) dismiss the application.
(2) If a
respondent fails to appear before the court that is to hear and decide the
application for a civil banning order and the court is satisfied that a copy
of the application has been served on the respondent, the court may— (a)
proceed to hear and decide the application in the absence of the respondent;
or
(b) adjourn the application, whether or not it makes an interim civil
banning order; or
(c) dismiss the application.
