Market entry restrictions
36 Market entry restrictions
(1) A regulation may declare that a public passenger service is to be provided
with market entry restrictions.
(2) Before a regulation is made under
subsection (1) , the Minister must be of the opinion that the following
criteria are met, or can be met or substantially met— (a) the level of
services would be greater than the level that would otherwise be provided;
(b) access to public passenger transport would be greater than would otherwise
be achieved;
(c) service innovation would be greater than would otherwise be
achieved;
(d) the particular public passenger services would better meet the
Government’s social justice objectives at a lower cost to the Government
than would otherwise be achieved.
