Particulars to be stated for complaint for vegetation clearing offence
68A Particulars to be stated for complaint for vegetation clearing offence
(1) This section applies to a complaint for a proceeding for a vegetation
clearing offence.
(2) It is enough, for identifying the vegetation cleared
and the place where the vegetation was cleared, for the particulars for the
complaint to state the following— (a) the number of hectares of vegetation
that have been cleared unlawfully;
(b) the location where the vegetation was
cleared;
(c) a description of the vegetation; Example— remnant vegetation
that is an endangered regional ecosystem and essential habitat for protected
wildlife
(d) whether the vegetation was in— (i) an area of high nature
conservation value; or
(ii) an area vulnerable to land degradation.
