WORKERS' COMPENSATION AND REHABILITATION ACT 2003 - SECT 116
Effect on entitlement if compensated under corresponding laws
116 Effect on entitlement if compensated under corresponding laws
(1) This section applies if, for an injury, payment (by whatever name called)
that corresponds to compensation under this Act is made to, or on account of,
a person under an entitlement under another law.
(2) The person’s
entitlement to compensation under this Act for the injury stops.
(3) However,
if the person’s entitlement under the other law relates only to payments
corresponding to compensation under chapter 4A , subsection (2) applies only
to stop the person’s entitlement to compensation under chapter 4 or 4A .
Examples of payments to which subsection (3) may apply— Payments under any
of the following schemes— (a) the scheme under the
National Disability Insurance Scheme Act 2013 (Cwlth) ;
(b) the scheme under
the National Injury Insurance Scheme (Queensland) Act 2016 ;
(c) a scheme
corresponding to the scheme mentioned in paragraph (b) under a law of a place
other than Queensland.
