(1) In deciding an appeal, the court—(a) has the same powers as the decision-maker; and(b) is not bound by the rules of evidence.
(2) An appeal is by way of rehearing.
(3) The court may—(a) confirm the decision; or(b) set aside the decision and substitute another decision the court considers appropriate; or(c) set aside the decision and return the matter to the Regulator with the directions the court considers appropriate.
(4) Despite subsections (1) to (3) , the court can not decide to issue or renew a licence to be a self-insurer under section 71 (2) or 72 (2) .
