Procedure for cancellation
96 Procedure for cancellation
(1) If the Regulator considers grounds exist to cancel a licence, the
Regulator must give the self-insurer written notice— (a) stating the grounds
for the cancellation and outlining the facts and circumstances forming the
basis for the grounds; and
(b) inviting the self-insurer to show, within a
stated time of at least 20 business days, why the licence should not be
cancelled.
(2) If, after considering all written representations made within
the stated time, the Regulator still considers that the licence should be
cancelled, the Regulator may cancel the licence.
(3) The Regulator must give
the self-insurer written notice of the decision to cancel the self-insurer’s
licence within 8 business days after making the decision.
(4) The notice
under subsection (3) must state— (a) the reasons for the decision; and
(b)
that the self-insurer may appeal against the cancellation under chapter 13 .
(5) The decision takes effect on the day stated in the notice.
(6) The
Regulator must record particulars of the cancellation.
