Failure to comply with rules
6 Failure to comply with rules
(1) A failure to comply with a rule is an irregularity and does not render a
proceeding, a document, step taken or order made in a proceeding a nullity.
(2) However, a DFVP court can make an order dealing with a failure to comply
with a rule if the court considers it appropriate.
(3) The DFVP court may
waive compliance with a rule, or excuse noncompliance with a rule, if the DFVP
court considers compliance with the rule would be inconsistent with— (a) the
main objects of the DFVP Act under the DFVP Act , section 3 ; or
(b) the
principles for administering the DFVP Act under the DFVP Act , section 4 .
