Power-assisted bicycles—Act, sch 4, definition power-assisted bicycle
353B Power-assisted bicycles—Act, sch 4, definition power-assisted bicycle
(1) This section prescribes, for the Act , schedule 4 , definition
power-assisted bicycle , vehicles that are, and vehicles that are not,
power-assisted bicycles.
(2) A vehicle mentioned in the Act , schedule 4 ,
definition power-assisted bicycle , paragraph (a) (i) is a power-assisted
bicycle if it— (a) is a pedalec; or
(b) has 1 or more electric auxiliary
motors with a maximum power output, or combined maximum power output, of not
more than 200 watts.
(3) A vehicle mentioned in the Act , schedule 4 ,
definition power-assisted bicycle , paragraph (a) (i) is not a power-assisted
bicycle if— (a) the vehicle has an internal-combustion engine; or
(b)
either or both of the following apply to the vehicle— (i) when propelled
only by the motor or motors, the vehicle is capable of going faster than
6km/h;
(ii) the motor or motors of the vehicle are capable of operating when
the vehicle is going faster than 25km/h.
(4) In this section—
"pedalec" has the meaning given by the Vehicle Standard (Australian Design
Rule—Definitions and Vehicle Categories) 2005 (Cwlth) .
