The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the ANZAC Day Commemoration (Veterans' Advisory Council) Amendment Act 2017.

2—Commencement

This Act will come into operation on a day to be fixed by proclamation.

3—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of ANZAC Day Commemoration Act 2005

4—Amendment of section 3—Interpretation

Section 3, definition of Council—delete the definition and substitute:

Council means the Veterans' Advisory Council established by the Minister as a non-statutory advisory body;

5—Repeal of Part 2

Part 2—delete the Part

6—Amendment of section 15—Establishment of Fund

(1) Section 15(2)(b)—delete "to the Council"

(2) Section 15(3)—delete "Council" and substitute:

7—Amendment of section 16—Application of Fund

(1) Section 16(1)—delete "the Council" and substitute:

the Minister, after consultation with the Council,

(2) Section 16(2)—delete subsection (2) and substitute:

(2) Each application made to the Minister for a payment out of the Fund must be referred to the Council for its consideration and the Council must make recommendations to the Minister in relation to such applications as the Council thinks fit.

(3) Section 16(3)—delete "Council" wherever occurring and substitute in each case:

Section 17—delete the section
