The Parliament of South Australia enacts as
follows:
This Act may be cited as the Criminal Assets Confiscation (Serious
Offences) Amendment Act 2007.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Criminal Assets Confiscation
Act 2005
3—Amendment of
section 3—Interpretation
(1) Section 3—after the definition of foreign forfeiture
order insert:
foreign offence includes an offence against international
law;
(2) Section 3, definition of serious offence—after
paragraph (c) insert:
or
(d) a foreign offence declared by the regulations to be within the ambit
of this definition;
4—Amendment of
section 10—Application of Act
Section 10(b)—delete paragraph (b) and substitute:
(b) a serious offence committed at any time whether the offence
occurred—
(i) in the case of a serious offence that is a foreign
offence—before or after the foreign offence was declared to be a serious
offence under this Act; and
(ii) in any case—before or after the commencement of this
Act,
and whether or not a person is convicted of the offence; and
