The Parliament of South Australia enacts as
follows:
This Act may be cited as the Criminal Law Consolidation (Provocation)
Amendment Act 2013.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Criminal Law Consolidation
Act 1935
After section 11 insert:
11A—Limitation on defence of
provocation
For the purposes of proceedings in which the defence of provocation may be
raised, conduct of a sexual nature by a person does not constitute provocation
merely because the person was the same sex as the defendant.
