The Parliament of South Australia enacts as
follows:
This Act may be cited as the Children's Protection (Harbouring)
Amendment Act 2012.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Children's Protection
Act 1993
3—Amendment
of section 52AA—Interpretation
Section 52AA—after the definition of child
insert:
senior police officer means a police officer of or above the
rank of Inspector.
4—Amendment
of section 52AAB—Direction not to harbour, conceal or communicate with
child
Section 52AAB(1), (2) and (3)—delete "The Chief Executive"
wherever occurring and substitute in each case:
A senior police officer
After section 52AAC insert:
52AAD—Summary proceedings
Proceedings in the Magistrates Court for an offence against this Division
may only be brought by a member of SA Police.
Schedule 1—Transitional
provision
A direction in force under section 52AAB of the Children's
Protection Act 1993 immediately before the commencement of this Act
continues in force as if it were a direction given by a senior police officer
under that section as amended by this Act.
