The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Education (Closure and Amalgamation of Government Schools) Amendment Act 2011.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Education Act 1972

3—Amendment of section 14A—Application of Part

Section 14A(2)—delete subsection (2) and substitute:

(2) However—

(a) this Part does not apply to the temporary closure of a Government school in an emergency or for the purposes of carrying out building work;

(b) sections 14B to 14F (inclusive) do not apply to the closure of a Government school if—

(i) a majority of the parents of the students attending the school; or

(ii) if the school is wholly or principally for adult students—a majority of the students attending the school,

indicate that they are not opposed to the closure.

4—Amendment of section 14F—Minister's decision as to closure or amalgamation

(1) Section 14F(1)—delete "The Minister" and substitute:

Subject to section 14G, the Minister

(2) Section 14F(2) and (3)—delete subsections (2) and (3) and substitute:

(2) The Minister must cause a copy of a committee's report and recommendations under section 14E to be laid before each House of Parliament within 6 sitting days of receiving the report and recommendations.

5—Insertion of section 14G

After section 14F insert:

14G—Requirement for resolution of both Houses of Parliament

Despite a provision of any other Act or law, a Government school cannot be closed or amalgamated with another except in accordance with a resolution passed by both Houses of Parliament.
