The Parliament of South Australia enacts as
follows:
This Act may be cited as the Electricity (Wind Power) Amendment
Act 2010.
This Act will come into operation 3 months after assent.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.

of section 36AC—Interpretation
Section 36AC, definition of qualifying generator—delete
the definition and substitute:
qualifying generator means—
(a) a small photovoltaic generator—
(i) that is operated by a qualifying customer; and
(ii) that complies with Australian Standard—AS 4777 (as
in force from time to time or as substituted from time to time); and
(iii) that is connected to a distribution network in a manner that allows
electricity generated by the small photovoltaic generator to be fed into the
network; or
(b) a wind turbine generator—
(i) that is operated by a qualifying customer; and
(ii) that complies with any standard prescribed by the regulations for the
purposes of this definition; and
(iii) that is connected to a distribution network in a manner that allows
electricity generated by the wind turbine generator to be fed into the
network,
other than where the distribution network is an excluded network;
