The Parliament of South Australia enacts as
follows:
This Act may be cited as the Fisheries Management (Fish Processors)
Amendment Act 2015.
This Act will come into operation 6 months after assent.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Fisheries Management
Act 2007
4—Amendment
of section 3—Interpretation
Section 3(1), definition of processing—delete the
definition and substitute:
processing—
(a) in relation to fish—means scaling, gilling, gutting, filleting,
freezing, chilling, packing, smoking, cooking or any other activity involved in
preparing fish for sale; or
(b) in relation to any other aquatic resource—means any activity
involved in preparing the aquatic resource for sale,
and includes the preparation of fish (whether cooked or uncooked) as a
meal;

of section 64—Applications for registration
(1) Section 64(1)(d)—before "be" insert:
subject to subsection (1a),
(2) Section 64—after subsection (1) insert:
(1a) No fee is payable
on application for registration as a fish processor made by a person who intends
only to prepare fish (whether cooked or uncooked) as a meal for sale.
(1b) Subsection (4) does not apply to the grant of registration as a fish
processor to a person exempted from payment of an application fee for
registration under
subsection (1a)
.
6—Amendment
of section 65—Conditions of registration
Section 65(1) and (2)—delete subsections (1) and (2) and
substitute:
(1) Registration as a fish processor is subject to the following
conditions:
(a) a condition that the processor will only process, store, transport or
deal with aquatic resources of a class specified in the registration;
(b) a condition that if the fish processor prepares fish (whether cooked
or uncooked) as a meal for sale, the fish processor will provide information to
the purchaser of the meal as to whether the fish is local or imported;
(c) such other conditions (including conditions limiting the activities
that may be carried out under the authority of the registration) as the Minister
thinks fit and specified in the registration.
