The Parliament of South Australia enacts as
follows:
This Act may be cited as the Food (Labelling of Free-range Eggs)
Amendment Act 2012.
This Act will come into operation 3 months after assent.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Food Act 2001
After section 22 insert:
22A—Requirements for free-range
eggs
A person must not, for the purpose of effecting or promoting the sale of
eggs in the course of carrying on a food business, cause the eggs to be
advertised, packaged or labelled in a way that describes the eggs that are for
sale as free-range, unless the egg producing chickens are maintained in
accordance with the following requirements:
(a) the number of egg producing chickens kept or housed per hectare does
not exceed 1 500;
(b) any other requirement prescribed by the regulations.
Maximum penalty:
(a) If the offender is a body corporate—$250 000.
(b) If the offender is a natural person—$50 000.
