The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Health Care (Private Day Procedure Centres) Amendment Act 2017.

2—Commencement

This Act will come into operation immediately after section 10 of the Health Care (Miscellaneous) Amendment Act 2016


comes into operation.

3—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Health Care Act 2008

4—Amendment of section 89—Preliminary

(1) Part 10A, section 89(1), definition of prescribed health service, (c)—delete paragraph (c)

(2) Part 10A, section 89(2)—delete subsection (2)

5—Insertion of section 89L

After section 89K insert:

89L—Exemptions

(1) The Minister may, by notice in the Gazette, confer exemptions from this Part or specified provisions of this Part—

(a) on specified persons or persons of a specified class; or

(b) in relation to specified prescribed health services or prescribed health services of a specified class.

(2) An exemption under subsection (1)


may be granted by the Minister on such conditions as the Minister thinks fit.

(3) The Minister may, at any time, by further notice in the Gazette—

(a) vary or revoke an exemption;

(b) vary or revoke a condition of an exemption or attach new conditions to an exemption.

(4) A person who contravenes or fails to comply with a condition imposed under this section is guilty of an offence.

Maximum penalty: $20 000.

6—Redesignation of section 89—Other staffing arrangements

Part 11, section 89—redesignate the section as section 89M

7—Amendment of section 92—Conflict of interest

Section 92(3), definition of health employee, (b)—delete "section 89" and substitute:

section 89M
