The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Local Government (Stormwater Harvesting) Amendment Act 2008.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

3—Amendment of Schedule 1A

Schedule 1A, after clause 18 insert:

18A—Authority to prepare plan to increase expenditure

(1) The Authority must, in addition to the other steps taken under this Schedule, prepare a plan to facilitate an increase in the expenditure on stormwater harvesting works over and above the amount expected to be spent on stormwater management under this Schedule during the 2008/2009 financial year (the base amount).

(2) The plan must propose an increase in expenditure over the base amount that is at least equal in each designated financial year to 10% of the amount received by the Land Management Corporation from the sale of land, after deducting the cost incurred in the sale of that land by the Land Management Corporation, for the 2007/2008 financial year (the designated amount), subject to the designated amount being adjusted for each designated financial year to take into account increases (if any) in the CPI during the 12 months ending on 30 March in the financial year immediately preceding each designated financial year.

(3) If, in respect of any designated financial year, the Authority does not receive sufficient funding to meet the requirements of the plan under subclause (1), the Minister must, within 12 sitting days after the end of that financial year, cause a report on the matter to be laid before each House of Parliament.

(4) In this clause—

CPI means the Consumer Price Index (All Groups Index for Adelaide) published by the Australian Bureau of Statistics;

designated financial year means each of the following financial years:

(a) 2009/2010;

(b) 2010/2011;

(c) 2011/2012;

(d) 2012/2013;

(e) 2013/2014;

stormwater harvesting works means works designated to enable stormwater to be captured, stored and reused.
