The Parliament of South Australia enacts as
follows:
This Act may be cited as the Motor Vehicles (Historic Number Plates)
Amendment Act 2012.
This Act will come into operation 3 months after the day on which it
is made.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Motor Vehicles
Act 1959
4—Amendment
of section 47A—Classes of number plates and agreements for allotment
of numbers
Section 47A—after subsection (5) insert:
(a) pursuant to an
agreement under subsection (4)—
(i) a person has the right to be allotted a particular number in respect
of a motor vehicle registered or to be registered in the person's name as an
owner; and
(ii) the person has the right to attach a number plate or plates that bear
that number to the vehicle; and
(b) that number is the original number allotted to the motor vehicle on
the first registration of the vehicle following its manufacture; and
(c) the number plate that bears that number is a numeric number plate
issued before 1967,
then, despite the terms of an agreement under subsection (4) requiring
the rights referred to in
paragraph (a) to be
transferred by public auction or some other means, those rights may be
transferred together with the transfer of the ownership of the motor vehicle to
a beneficiary of the deceased estate of the registered owner, or to an immediate
family member of the registered owner.
(5b) On a transfer of rights under
subsection (5a)—
(a) the agreement under subsection (4) between the Registrar and the
registered owner who transferred the ownership of the motor vehicle will be
taken to be terminated; and
(b) an agreement in the same terms and on the same conditions as the
terminated agreement will be taken to have been entered into under
subsection (4) between the Registrar and the person to whom ownership of
the vehicle has been transferred.
(5c) In this section—
child includes an adopted child, a step-child or an
ex-nuptial child;
close personal relationship means the relationship between
2 adult persons (whether or not related by family and irrespective of their
gender) who live together as a couple on a genuine domestic basis, but does not
include—
(a) the relationship between a legally married couple; or
(b) a relationship where 1 of the persons provides the other with
domestic support or personal care (or both) for fee or reward, or on behalf of
some other person or an organisation of whatever kind;
Note—
Two persons may live together as a couple on a genuine domestic basis
whether or not a sexual relationship exists, or has ever existed, between
them.
domestic partner—a person is the domestic partner of
another if he or she lives with the other in a close personal
relationship;
immediate family member of a person means—
(a) the person's spouse or domestic partner; or
(b) a child or grandchild, parent, grandparent or sibling of the person or
of the spouse or domestic partner of the person;
numeric number plate means a number plate issued before 1967,
that consists entirely of figures (except for the letters "SA" designating the
State of issue).
