The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Motor Vehicles (Suitability to Hold Licence) Amendment Act 2017.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Motor Vehicles Act 1959

3—Amendment of section 82—Vehicle offences and unsuitability to be granted or hold licence or permit

(1) Section 82(1)—delete "such that it appears that the person should not hold a licence or permit, or should hold a licence subject to conditions, in order to prevent accident or injury or a repetition of the offence or" and substitute:

or has behaved in some other manner that, in the opinion of the Registrar, indicates that the person should not hold a licence or permit, or should hold a licence subject to conditions, in order to minimise the risk of accident or injury or the commission of

(2) Section 82—after subsection (1) insert:

(1a) In determining whether to take any action in relation to a person under subsection (1), the protection of the public must be the paramount consideration and the Registrar need not take into account any hardship that may be caused to the person by taking the action.

(3) Section 82(2)(b)—delete "it no longer appears that the person should not hold a licence or permit in order to prevent accident or injury or a repetition of the offence or" and substitute:

the action that was taken by the Registrar is no longer desirable in order to minimise the risk of accident or injury or the commission of
