1 Hunting
permits
The Parliament of South Australia enacts as
follows:
This Act may be cited as the National Parks and Wildlife (Ban On Hunting
Protected Animals) Amendment Act 2009.
(1) Subject to subsection (2), this Act comes into operation on the
day on which it is assented to by the Governor.
(2) Sections 5 to 8 (inclusive) and Schedule 1 of this Act will come
into operation 2 months after the day on which the Act is assented to by
the Governor.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.

of National Parks and Wildlife
Act 1972
4—Amendment of
section 19E—Establishment of advisory committees
Section 19E(4)(iv)—delete paragraph (iv)
Section 52—delete the section
6—Amendment of
section 68A—Hunting permits
Section 68A(3)—delete subsection (3) and substitute:
(3) A permit under this section cannot authorise—
(a) the hunting of a protected animal; or
(b) hunting within the Adelaide Dolphin Sanctuary; or
(c) the possession, while in that Sanctuary, of a firearm or other device
for the purpose of hunting.
Section 68E—delete section 68E and substitute:
68E—Exemption from Act
Nothing in this Act prevents an Aboriginal person from hunting a protected
animal, or hunting an animal other than a protected animal without a permit, if
the animal hunted will be used—
(a) as food for the hunter or for his or her dependants; or
(b) solely for cultural purposes of Aboriginal origin.

Schedule
1—Transitional provisions
(1) A permit authorising the hunting of a protected animal issued under
section 68A of the principal Act as in force immediately before the
commencement of this clause will, despite any term specified in the permit,
expire on the commencement of this clause.
(2) The Minister must refund to the holder of each permit expiring by
virtue of subclause (1) the amount determined by the Minister to represent
the balance of the term of the permit had it not so expired.
