The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Parliamentary Remuneration (Basic Salary Determinations) Amendment Act 2009.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Parliamentary Remuneration Act 1990

3—Amendment of section 3—Interpretation

(1) Section 3, definition of basic salary—delete the definition and substitute:

basic salary means the amount determined, from time to time, by the Remuneration Tribunal as the annual basic salary payable to a member of Parliament (provided that the determination has been confirmed by regulation under section 3A);

(2) Section 3, definition of Commonwealth basic salary—delete the definition

4—Insertion of section 3A

After section 3 insert:

3A—Confirmation of basic salary determination

(1) A determination of the Remuneration Tribunal as to the amount of the annual basic salary is of no force or effect unless and until a regulation is made confirming the determination.

(2) A regulation referred to in subsection (1) may not come into operation until the time for disallowance under the Subordinate Legislation Act 1978 has passed.

(3) For the avoidance of doubt, if a regulation confirming a determination of the Remuneration Tribunal is disallowed—

(a) the determination will be taken to be of no force or effect; and

(b) if the disallowed regulation revoked a regulation confirming a previous determination of the Remuneration Tribunal, that revoked regulation and the determination of the Remuneration Tribunal that it confirmed are revived.

Schedule 1—Transitional provisions

The amount that is, immediately before the commencement of this Act, payable to a member of Parliament as the member's basic salary (within the meaning of section 3 of the Parliamentary Remuneration Act 1990) is, on the commencement of this Act, taken to be the basic salary within the meaning of that section as amended by this Act.
