The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Statutes Amendment (Public Sector Consequential Amendments) Act 2009.

2—Commencement

(1) This Act will come into operation on a day to be fixed by proclamation.

(2) Section 7(5) of the Acts Interpretation Act 1915 does not apply to this Act.

3—Amendment provisions

(1) In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

(2) If an Act sought to be amended by a provision of this Act is, before the commencement of the provision, amended in a manner that renders the amendment ineffective, that amendment will be taken to have been struck out of this Act.

Part 2—Amendment of Aboriginal Heritage Act 1988

(c) that has been under consideration by the board on a previous occasion or occasions and the board has resolved that there is no real or substantial reason why the member should not be present in the circumstances of the particular case.

(2) For the purposes of this section, a person has a substantial shareholding in a public company if the person has a substantial shareholding in the company for the purposes of Chapter 6 of the Corporations Act 2001 of the Commonwealth.

(3) In this section—

public company means a public company as defined in section 9 of the Corporations Act 2001 of the Commonwealth.
