The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Surveillance Devices (Animal Welfare) Amendment Act 2016.

2—Commencement

This Act will come into operation immediately after Part 2 Division 2 of the Surveillance Devices Act 2016


comes into operation.

3—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Surveillance Devices Act 2016

4—Amendment of section 6—Listening devices and optical surveillance devices—public interest exception

Section 6—after subsection (2) insert:

(3) For the purposes of this section, the use of a listening device or an optical surveillance device to obtain information or material relating to issues of animal welfare will, in the absence of proof to the contrary, be taken to be in the public interest.

5—Amendment of section 10—Communication or publication of information or material—public interest

(1) Section 10(2)—after paragraph (b) insert:

or

(c) the information or material relates to issues of animal welfare.

(2) Section 10—after subsection (2) insert:

(3) For the purposes of this section, the use of a listening device or an optical surveillance device to obtain information or material relating to issues of animal welfare will, in the absence of proof to the contrary, be taken to be in the public interest.
