The Parliament of South Australia enacts as follows:

Part 1—Preliminary

1—Short title

This Act may be cited as the Victims of Crime (Compensation Limits) Amendment Act 2011.

2—Amendment provisions

In this Act, a provision under a heading referring to the amendment of a specified Act amends the Act so specified.

Part 2—Amendment of Victims of Crime Act 2001

3—Amendment of section 17—Eligibility to make claim

Section 17(5)—after paragraph (e) insert:

and

(f) a person is not entitled to statutory compensation if the person has received compensation for the same harm under the repealed Criminal Injuries Compensation Act 1978 (or under an Act repealed by that Act).

4—Amendment of section 20—Orders for compensation

(1) Section 20(1)(c)—after "$10 000" insert:

(2) Section 20(1)(d)(ii)—after "$7 000" insert:

(3) Section 20(3)(a)(i)—after "$20 000" wherever occurring insert:

(indexed)

(4) Section 20(3)(a)(ii)—after "$1 000" insert:

(5) Section 20(3)—delete "$50 000" wherever occurring and substitute in each case:

$100 000 (indexed)

(6) Section 20(3)(b)—after "$10 000" insert:

(indexed)

(7) Section 20—after subsection (11) insert:

(12) In this section, if a monetary amount is followed by the word "(indexed)", the amount is to be adjusted on 1 January of each year, beginning in 2013, by multiplying the stated amount by a multiplier obtained by dividing the CPI for the quarter ending 30 June in the previous year by the CPI for the quarter ending 30 June 2011.

(13) In this section—

CPI means the Consumer Price Index (All groups index for Adelaide).

5—Substitution of section 34

Section 34—delete the section and substitute:

34—Application of Act

(1) This Act applies in relation to a crime, or alleged crime, whether committed, or allegedly committed, before or after the commencement of this Act.

(2) An application for statutory compensation is to be determined in accordance with the provisions of this Act as in force at the time of the application.

6—Amendment of Schedule 1—Repeal and transitional provisions

Schedule 1—delete clauses 1 and 2
