The Parliament of South Australia enacts as
follows:
This Act may be cited as the Whistleblowers Protection (Miscellaneous)
Amendment Act 2009.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Whistleblowers Protection
Act 1993
3—Amendment of
section 3—Object of Act
Section 3—after "sector" insert:
, of breaches of the public trust, of scientific misconduct, of conduct
causing a substantial risk of danger to public health or safety or to the
environment
4—Amendment of
section 4—Interpretation
(1) Section 4(1)—after the definition of adult
insert:
detriment includes—
(a) injury, damage or loss; or
(b) intimidation or harassment; or
(c) discrimination, disadvantage or adverse treatment in relation to a
person's employment; or
(d) threats of reprisal;
(2) Section 4(1), definition of public interest
information—after subparagraph (iii) insert:
(iiia) in a breach of the public trust; or
(iiib) in scientific misconduct; or
(3) Section 4(1), definition of public officer—after
paragraph (g) insert:
or
(h) a person performing a duty or function, or otherwise holding a
position, under any Act of the State (regardless of the nature of the
arrangement under which the person performs the duty or function, or holds the
position); or
(i) any other person declared by the regulations to be included in the
ambit of this definition.
(4) Section 4(2)—delete subsection (2)
5—Amendment of
section 5—Immunity for appropriate disclosures of public interest
information
Section 5(4)—after paragraph (j) insert:
(k) if the person making the disclosure believes on reasonable grounds
that disclosing the information to another appropriate authority would cause
detriment to the person or that such authority would not act on the
information—to a member of the media.

section 9—Victimisation
Section 9(4)—delete subsection (4)
