The Parliament of South Australia enacts as
follows:
This Act may be cited as the Workers Rehabilitation and Compensation
(Retirement Age) Amendment Act 2012.
In this Act, a provision under a heading referring to the amendment of a
specified Act amends the Act so specified.
Part 2—Amendment
of Workers Rehabilitation and Compensation
Act 1986
3—Amendment
of section 35—Preliminary
Section 35(8)(d)—delete paragraph (d) and
substitute:
(d) a worker reaches retirement age when—
(i) he or she reaches the normal retirement age (if any) for workers in
employment of the kind from which the worker's injury arose; or
(ii) he or she reaches pension age for the purposes of the Social
Security Act 1991 of the Commonwealth (other than for the purposes of
Part 3.14A or 3.14B of that Act),
whichever occurs first;
(da) if a worker's pension age for the purposes of the Social Security
Act 1991 of the Commonwealth is less than the age of 65 years, he or
she will be taken for the purposes of paragraph (d)(ii) to reach pension
age when he or she reaches the age of 65 years;
