(a)
where damages are claimed for personal injury arising from—
(i)
a motor accident (whether caused intentionally or
unintentionally); or
(ii)
an accident caused wholly or in part by—
(A) negligence; or
(B) some other unintentional tort on the
part of a person other than the injured person; or
(C) a breach of a contractual duty of care;
or
(b)
where personal injury arising in the manner described in paragraph (a)
results in death and damages are claimed under Part 5 for harm resulting from
the death.
