(1) This Part does not
apply to, or in relation to, a child.
Note—
Section 12 sets out who can consent to the administration of medical
treatment (other than prescribed treatment) to a child.
(2) This Part does not
apply to, or in relation to, a person who has given an advance care directive
to the extent that—
(a) a
substitute decision-maker has been appointed under the advance care directive
who is authorised to make decisions relating to the administration of
medical treatment of the relevant kind to the patient; or
(b) the
advance care directive makes specific provision in respect of the
administration of medical treatment of the relevant kind to the patient.
(3) This Part does not
apply to, or in relation to, prescribed treatment (within the meaning of the
Guardianship and Administration Act 1993 ).
Note—
Under the Guardianship and Administration Act 1993 , prescribed
treatments include terminations of pregnancy and sterilisations.
(4) Nothing in this
Part limits the operation of section 13.
