214—Contribution between councils where road is on boundary between
council areas
(1) If a council
carries out roadwork on a road on the boundary between two council areas, the
council is entitled to a reasonable contribution from the other council
towards the cost of the work.
(2) The contribution
will be—
(a) an
amount agreed between the councils; or
(b) in
the absence of agreement—an amount determined by the court in which the
action for contribution is brought.
(3) A council is not
entitled to contribution under this section unless the council seeking
contribution gives the other council reasonable notice of the nature of the
proposed roadwork and allows the council a reasonable opportunity to make
representations about the proposed work—but notice is not required in a
case of urgency.
