(1) The Panel may
inquire into a complaint referred to the Panel under this Subdivision in such
manner as the Panel considers appropriate.
(2) However, an
inquiry must be conducted in accordance with the principles of procedural
fairness.
(3) In addition, the
Panel must ensure that, during an inquiry relating to a complaint where the
person primarily affected by the behaviour that is the subject of the
complaint is an employee of a council, any registered industrial association
representing the employee in the matter is given an opportunity to make
submissions relating to the inquiry.
