130—Covenant to be implied in every mortgage
In every mortgage and encumbrance there shall be implied a covenant by the
mortgagor or encumbrancer with the mortgagee or encumbrancee that he will
repair and keep in repair all buildings and other improvements erected and
made upon the mortgaged or encumbered land, and that the mortgagee or
encumbrancee may, at all convenient times, until the mortgage or encumbrance
be redeemed, be at liberty, with or without surveyors or others to enter into
and upon such land to view and inspect the state of repair of such buildings
and improvements.
