398—Prohibition on eating, drinking and smoking
(1) A
person conducting a business or undertaking at a workplace must take all
reasonable steps to ensure that a person does not eat, drink, chew gum, smoke
or carry materials used for smoking in a lead process area at the workplace.
Maximum penalty:
(a) In
the case of an individual—$6 000.
(b) In
the case of a body corporate—$30 000.
(2) A
person conducting a business or undertaking at a workplace must provide
workers with an eating and drinking area that, so far as is reasonably
practicable, cannot be contaminated with lead from a lead process.
Maximum penalty:
(a) In
the case of an individual—$3 600.
(b) In
the case of a body corporate—$18 000.
