460—Asbestos removal worker must be trained
(1) A licensed
asbestos removalist must not direct or allow a worker to carry out licensed
asbestos removal work unless the removalist is satisfied that the worker holds
a certification in relation to the specified VET course for asbestos removal
relevant to the class of licensed asbestos removal work to be carried out by
the worker.
Maximum penalty:
(a) In
the case of an individual—$6 000.
(b) In
the case of a body corporate—$30 000.
(2) A licensed
asbestos removalist must provide appropriate training to a worker carrying out
licensed asbestos removal work at a workplace to ensure that the work is
carried out in accordance with the asbestos removal control plan for the
workplace.
Maximum penalty:
(a) In
the case of an individual—$6 000.
(b) In
the case of a body corporate—$30 000.
(3) In this
regulation—
"appropriate training" means training designed specifically for the workplace
where the licensed asbestos removal work is carried out and the work to be
carried out at the workplace.
Note—
Unless this regulation applies, the obligation to provide training to workers
carrying out unlicensed asbestos removal work is set out in
regulation 445.
