In this Chapter, "mineral"—

            (a)         means—

                  (i)         a naturally occurring element or inorganic compound; or

                  (ii)         coal, lignite, peat or oil shale; or

                  (iii)         rock, stone, gravel or sand; and

            (b)         does not include—

                  (i)         water; or

                  (ii)         petroleum or any other substance, the recovery or production of which is governed by the Petroleum and Geothermal Energy Act 2000 .
