613—Meaning of " "mine operator"
(1) In this Chapter,
the "mine operator" of a mine is the mine holder of the mine, unless the
mine holder appoints another person to be the mine operator.
(2) The mine holder of
a mine may appoint a person to be the mine operator only if—
(a) the
person is conducting a business or undertaking and is appointed in accordance
with regulation 615 to carry out mining operations at the mine on behalf
of the mine holder; and
(b) the
mine holder authorises the person to have management or control of the mine
and to discharge the duties of a mine operator under the Act.
(3) To avoid doubt, a
reference in these regulations to a person conducting a business or
undertaking at a mine includes a reference to the mine operator of the mine.
