650—Requirements if air quality requirements and exposure standards not
complied with
(1) This regulation
applies if monitoring reveals that in an underground mine—
(a) the
oxygen level specified in regulation 648(1)(a) is not met; or
(b) a
dust level referred to in regulation 648(1)(b)(ii) is exceeded; or
(c) an
exposure level referred to in regulation 648(2)(b) is exceeded.
(2) The mine operator
of an underground mine must immediately notify any affected workers or other
persons at the mine of the relevant circumstance referred to in
subregulation (1).
Maximum penalty:
(a) in
the case of an individual—$6 000;
(b) in
the case of a body corporate—$30 000.
(3) The mine operator
of an underground mine must ensure that the air quality at the mine is
retested by a competent person as soon as practicable.
Maximum penalty:
(a) in
the case of an individual—$6 000;
(b) in
the case of a body corporate—$30 000.
