A code of practice approved by the Minister for the purposes of the Act that
is specified to come into operation on 1 January 2013 (being the day on which
the Act comes into operation)—
(a) will
be taken to have been approved on the recommendation of the Advisory Council
if it has been the subject of a recommendation of the Advisory Committee under
the repealed Act; and
(b) will
be taken not to be subject to the requirement that applies under
section 274(3) of the Act before it can take effect for the purposes of
the Act.
