ANTI-DISCRIMINATION AMENDMENT BILL 2015 This Public Bill originated in the House of Assembly, and, having this day passed, is now ready for presentation to the Legislative Council for its concurrence. SHANE DONNELLY, Clerk of the House 30 April 2015 (Brought in by the Minister for Education and Training, the Honourable Jeremy Page Rockliff) A BILL FOR An Act to amend the Anti-Discrimination Act 1998 Be it enacted by Her Excellency the Governor of Tasmania, by and with the advice and consent of the Legislative Council and House of Assembly, in Parliament assembled, as follows: 1. Short title This Act may be cited as the Anti-Discrimination Amendment Act 2015. 2. Commencement This Act commences on the day on which this Act receives the Royal Assent. 3. Principal Act In this Act, the Anti-Discrimination Act 1998* is referred to as the Principal Act. *No. 46 of 1998 [Bill 8] 3

 


 

Anti-Discrimination Amendment Act 2015 Act No. of s. 4 4. Section 51A inserted After section 51 of the Principal Act, the following section is inserted in Division 8: 51A. Admission of person as student based on religion (1) A person may discriminate against another person on the ground of religious belief or affiliation or religious activity in relation to admission of that other person as a student to an educational institution that is or is to be conducted in accordance with the tenets, beliefs, teachings, principles or practices of a particular religion if the other person does not share those tenets, beliefs, teachings, principles or practices. (2) Subsection (1) does not apply to a person who is enrolled as a student at the educational institution referred to in that subsection. (3) Subsection (1) does not permit discrimination on any grounds other than those specified in that subsection. 5. Sections 55A and 55B repealed Sections 55A and 55B of the Principal Act are repealed. 4

 


 

Anti-Discrimination Amendment Act 2015 Act No. of s. 6 6. Repeal of Act This Act is repealed on the three hundred and sixty fifth day from the day on which it commences. Government Printer, Tasmania 5
